STATEMENT OF FACT



The HMS Intrepid Association was founded out of the development of the HMSIntrepid.com website (created June 2007) membership and officially constituted at the Inaugural AGM in June 2009. The HMS Intrepid Association has an elected committee of eight members and a formal constitution.

In January 2010, Mr George Heron resigned as a committee member of the HMS Intrepid Association. The resignation was unilateral on his part.

Mr George Heron has established a website hmsintrepid.co.uk. On this website, Mr George Heron describes it as being the ‘official site of the HMS Intrepid Association’. THIS IS AN INCORRECT STATEMENT.

In March 2010, Mr George Heron registered a company at Companies House named HMS Intrepid Association Limited. The HMS Intrepid Association immediately registered a dispute with the Secretary of State through Companies House and with Mr George Heron regarding the registered name, citing that an organisation already existed by that name and had already established a substantial reputation and goodwill.

The HMS Intrepid Association is attempting to discuss the registered name with Mr George Heron in accordance with the recommended advice published by Companies House, regarding company name disputes.

The HMS Intrepid Association wishes to disclaim any liabilities incurred by the activities of the registered company HMS Intrepid Association Limited.

As a result of my efforts to secure the name I was contacted by Mike Fleming who was demanding that I transfer ownership of the name to the committee. He then placed a ‘statement of fact’ into the public domain denouncing me and my legitimate activities. Mr Fleming stated in his statement that he had lodged a complaint with Companies house over my registration and he had done this in your interests. I have contacted the administrators of this authority and no such complaint was made to them.

Dear Sir/Madam

On behalf of the HMS Intrepid Association, I wish to object to the recent
registration of HMS Intrepid Association (Limited exemption), registration
number 07178908.

The HMS Intrepid Association was founded in June 2008 and was formalised at
the inaugural General Meeting in June 2009, at the Paragon Hotel in
Birmingham.

The company registration is in the name of George Antony Heron, who was
until January 2010 the Secretary of the HMS Intrepid Association. Mr Heron
resigned from the committee, and his resignation was acrimonious. We
continue to be in dispute with Mr Heron over some of the Association assets.

We learnt this week of his activity to register the Association as a company
in his name, and we object to this registration as the name is too alike to
the HMS Intrepid Association and that this is an opportunistic registration
to thwart the Association's activities.

Please advise what further evidence you require of our objection to this
registration.
